Over the past few months, on three occasions, I have experienced something rarely seen before in Sotogrande. The legal representative of a potential buyer has requested a “Certificate of No Urban Infringement” for a property his client is looking to buy. On every occasion the request has come from a Marbella based lawyer.
Having investigated what this certificate is all about I can see why Marbella lawyers have become accustomed to this practice. With many years of town hall corruption, thankfully now part of the past, lawyers have nevertheless retained this custom and now seek the same reassurance here in Sotogrande.
Fortunately, Sotogrande never suffered the corruption seen in Marbella, but unfortunately, we are seeing delays in completions due to our local town hall not being staffed sufficiently to expedite the granting of certificates with sufficient agility.
So, what is really this “Certificate of No Urban Infringement”?

Having this certificate will help a sale of a property go smoothly. Having all the documents of the property in place, creates confidence in the possible buyer and his own solicitor.
It should be noted that if there is a fine affecting a property, it will not be shown in the deeds and / or any other of the property documents. This information can only be obtained at the local Town Hall of the area.
Its possession is the guarantee of living in a building within the urban legality and without fear of having to face some administrative penalty.

The term for issuing the certificate may vary on each municipality. It usually takes 2 weeks and up to 3 months depending on each locality.
