What is a Nota Simple?
A NOTA SIMPLE is a Spanish informative document. It is a succinct extract of the content of the current entries of a property at the registry.
If you are you thinking of buying a property, this is a very useful and important document that your lawyer will request before purchasing a home. In it, you will be able to know the properties ownership and debt “status”, including the registered owners name, if the property has a mortgage, if the property owes taxes, and other important relevant information.
In Spain, debts may be tied to a property rather than to the owner of the property. When the owner goes to sell this property, these debts are apparent to the prospective buyer.
Another fundamental piece of information the Nota Simple must include is related to the description of the property. Here we find the registered measurements of the property in square meters, how it is is divided, the boundaries, and the cadastral reference of the property. The cadastral reference is a unique alphanumeric code of 20 characters and serves to identify the property.
The Nota Simple will also specify if the property has prohibitions or restrictions that affect the owners’ rights over the property, that is, that the property is free of charges or incumbrancers that could prevent its sale. You will learn if the property has a mortgage against it, if it has been embargoed, if it is in the judicial auction, etc. Additionally, the Nota Simple tells you about the rights that others may have on the property, such as public paths/roads, water or sewage lines.
It is very important that, as a new owner of a property, and once the sale is formalized, you request an updated Nota Simple. There you will verify that you are the new owner of the acquired property!
